  1. Description of the Platform

2.1 The Platform and Services comprise an online platform through which: a) Users can view and obtain information regarding a Proposal; b) Organizers can submit their own Proposals; Users can search for Organizers’ Proposals and send a request for participation to one or more of them. The Organizer benefits from an online space on which it can register its Proposal format and present it, making explicit any ancillary services rendered therein, as well as the economic contributions required for participation and aimed at reimbursing, even as a lump sum, the expenses incurred in organizing, managing and conducting the Proposal (hereinafter, the Contribution). Gonnadu reserves the right to approve the Proposals submitted by the Organizers. It is understood that Gonnadu has no burden of control over the conduct of Users and excludes any liability in this regard to the maximum extent permitted by law.

  1. Privacy

The User declares to have read Gonnadu’s Privacy Policy, available at https://www.gonnadu.com/privacy-policy-app/nonché on the appropriate section of the App, as amended from time to time; this Policy governs Gonnadu’s acquisition and use of Users’ Personal Data.

In particular, Gonnadu acknowledges and confirms that any processing of personal data arising from the execution of the T&Cs will be carried out solely for the purposes related to such execution or for the other purposes for which the User has given express and unequivocal consent, and in any case in compliance with the provisions of Legislative Decree 196/2003 and ss.mm., Legislative Decree 101/2018 as well as EU Reg. 679/2016.

  • the name, company name or business name and the domicile, residence or seat of the data controller.

4. User Account

In order to register and take advantage of the service, each User must first create an Account, providing the personal data concerning him or her that are indispensable for the proper functioning of the people-to-people communication service. Users, by creating the Account, certify that they are at least 18 years old at the time of their registration.

When filling in the forms prepared in the section reserved for the User, the User will indicate a User Id (of which the system will automatically verify the uniqueness) and the preferred password. In case the User-Id is already present in the database, The User will have to indicate an additional one until the system will positively verify its uniqueness. The User-Id together with the password, will constitute the Authentication Credentials.

The User-Id will allow the identification of the User, as the party to whom the activity or services requested on the Platform should be referred.

The Authentication Credentials are personal, confidential and non-transferable.

The User agrees not to provide any incorrect or false information. In any case, Gonnadu cannot in any case be held responsible for the incorrectness or falsity, whether blameless, guilty or malicious, of the information communicated by Users.

Each User agrees to use only and exclusively the Account initially created, regardless of whether it was registered under his or her own identity or that of a third party. Under no circumstances may the User use the Account of a third party. Any exception to this rule must be explicitly requested by the User to Gonnadu. The User may then proceed only against the explicit and specific authorization of Gonnadu. In the absence of such explicit authorization, the creation or use of new accounts under the User’s own identity or that of third parties may result in the immediate and indefinite Suspension of the User’s accounts or their permanent deletion.

4.1 User Account Deletion

The process allowing users to delete their Account is the following:

  • User Request: the user initiates the account deletion process by contacting customer support or submitting a deletion request through the app. This request should be explicit and include information to identify the user’s account, such as their username or email.
  • Verification: Customer support verifies the user’s identity to ensure that the deletion request is legitimate. This step is critical to prevent unauthorized deletion of accounts.
  • Confirmation: once the user’s identity is confirmed, customer support sends a confirmation message to the user. This message includes details about what data will be deleted and any potential consequences, such as the irreversible loss of account information, proposals, and interactions.
  • Account Deletion: Customer support initiates the account deletion process.

User Profile: The user’s profile information, including their name, email, and account preferences, is permanently removed from the database.

Proposals: All proposals created by the user are deleted. This includes any associated data, such as proposal details, comments, and participant information.

Interactions: Any user interactions, such as likes, follows, or messages, are anonymized to protect the privacy of other users.

  • Data Erasure Confirmation: once the deletion process is complete, customer support sends a confirmation message to the user, informing them that their account and associated data have been permanently deleted.
  • Compliance and Record-Keeping: the app’s administrators ensure that the deletion process complies with relevant privacy regulations, such as GDPR or CCPA. Records of the deletion request and the actions taken are maintained for compliance purposes.
  • Feedback and Support: if the user has any questions or concerns regarding the deletion process, they can contact customer support for further assistance.
  • Periodic Audits: the app’s administrators periodically audit the deletion process to ensure that it remains effective and compliant with evolving privacy regulations. By following this comprehensive process, the user’s account and associated data can be effectively and securely deleted while maintaining compliance with privacy laws and regulations. Additionally, this process helps protect the user’s privacy and ensures that their data is handled with care and transparency.

  1. Booking

Information about the Proposals, provided by the Organizers, is made available on the Platform, in which the characteristics and any ancillary services made available are described: date, times, Proposal type, maximum number of participants, minimum number of participants, Contributions and any other relevant information (hereinafter, the Description Sheet). Under no circumstances is the Organizers allowed to reserve the right to supplement and/or change the features, details and description of the proposals outside the cases provided for in these T&Cs.

A User who intends to book one or more places at an Organizer’s Proposal shall make a Request for Participation on the Platform (hereinafter, the Request for Participation). If a User makes a Request for Participation for himself/herself and for an entity outside the Platform (hereafter, the Invitee), the Inviting User shall inform the Invitee of the need to read and fully accept these T&Cs.

The Reservation process is completed upon receipt of the confirmation of the Request for Participation by Gonnadu, sent upon completion of the payment of the Contribution made in the manner set forth in Article 6 below. It is understood that Gonnadu has the right to cancel the Proposal at any time, without prejudice to the right to Reimbursement for Users whose Request for Participation had already been confirmed.

5.1 Refunds

Without prejudice to Gonnadu’s extraneousness with respect to the relationships established between Users and Organizers, if the User cannot, for any reason, participate in the Proposal, he/she shall have the right to request a refund of what has already been paid to the Organizer through the Platform, deducting the part for which Gonnadu is responsible for managing the refund, under the following conditions:

– if within the indicated hours prior to the Proposal, as defined by the Organizer in the terms of cancellation of the Proposal, the request may be forwarded to Gonnadu, which will manage the communication with the Organizer. It is understood that the reimbursement is, however, to be paid exclusively by the Organizer and carried out by Gonnadu.

– If the request is made after the hours before the Proposal defined by the Organizer in the respective terms of cancellation, the right to reimbursement is excluded.

If the Proposal has not been held for reasons attributable to the Organizer, Gonnadu is entitled to refund to the User what has already been paid by the latter. The reimbursement will take place through the allocation of a Voucher of the value of the amount to be reimbursed and usable for participation in other Proposals.

It is understood that, the User to whom reimbursement by Voucher is granted may request, by specific and express request with written notice to be sent by e-mail to support@gonnadu.com within 8 months from the allocation of the Voucher (under penalty of forfeiture), that the amount of the Voucher be paid in cash. In order to obtain the reimbursement, the User must send the request exclusively to the address support@gonnadu.com from the e-mail account used to create the User Account and specify for which Proposal the reimbursement is requested.

The request must contain the following information:

– the bank details (IBAN) of the User’s bank account to which the refund will be credited;

– the holder of the bank account;

– the e-mail associated with the User Account provided when registering for the Platform;

– the express indication of receiving the reimbursement in the form of a voucher or in cash in the cases in which this option is permitted, as indicated in this paragraph;

Once Gonnadu has proceeded with the refund, it will notify its completion by means of a notice to the e-mail address used for the refund request. It should be noted that the reimbursement timelines follow the ordinary timelines of the banking circuit employed and do not depend on Gonnadu.

It is understood that the reimbursement request may only be submitted through the User Account with which the Proposal was booked and whose reimbursement is requested. Therefore, third parties will not be able to proceed to request reimbursement in the name and on behalf of other Users by employing the aforementioned procedure. Otherwise, the request will not be considered and will be deemed as not submitted.

In any case, the refundable amount corresponds to an amount equal to the Contribution already paid, minus the expenses for handling the refund request made explicit by Gonnadu at the stage of taking charge of the request.

  1. Referral

Gonnadu encourages Utentis to expand the number of Users registered on the Platform through communication and invitation of new users to use the Service (hereinafter, Referral).

Gonnadu confers, in varying promotional periods, a free bonus, of the value and in the manner described below, to all Users who make a Referral allowing Gonnadu to acquire a new User who registers on the Platform (hereinafter, New User).

6.1 Referral Process

The User has the option of inviting, by e-mail communication, or other digital channel, a new party to participate in his or her first proposal on Gonnadu (after registering on the platform, where not previously made). Such invitation will include an alpha-numeric code (Referral Code) to be used during checkout. Such code represents in fact a personal discount code of the User, which entitles the User to a maximum of 5.00 euros off the contribution.

Only after the purchase of the Service by the New User, the User who proceeded to the Referral will in turn obtain a bonus worth 5.00 euros always in the form of spendable credit for future booking to a Proposal.

Gonnadu reserves the right to suspend the Service, remove the New User and refuse the conferment of the bonus if there is a well-founded suspicion that the User has obtained the bonus through deception and/or abuse of the system such as, but not limited to, the use of fictitious e-mail address created for the exclusive purpose of obtaining the bonus. The bonus is valid for 3 months from the time of the New User’s registration. In case the New User does not use the Service within this period, the New User and the Inviting User will forfeit the right to use the bonus. In the event that the New User uses the Service using the bonus and the Inviting User does not use the Service within the next 3 months, the Inviting User will forfeit the right to use the bonus for any subsequent Proposal.

6.2 Value of the bonus

The bonus is conferred in cumulative form and applies only and exclusively to the price of the credit. It is understood, therefore, that the bonus does not apply to the cost of the Platform Service, which will always be due in its entirety.

  1. Payments

Gonnadu makes available to Users and Organizers a third-party service, mediated by which the User wishing to participate in a Proposal may proceed to pay the Contribution. Gonnadu, therefore, in no way acts or operates as an official seller or payment service provider, merely providing access to the Platform and its maintenance. Payment through the Platform shall in all cases constitute payment, in whole or in part, by the User, of the Contribution for participation in the Proposal and may not be claimed in any way by the User, subject to the provisions of Section 5.2 of the T&Cs.

For the payment, to be made by credit or debit card, the User will be able to take advantage of the service offered by third parties, through the Platform: he/she will have to connect, following the instructions on the Platform, to the secure circuit of Gonnadu’s partner (Stripe – managed by Stripe Inc.) that guarantees the confidentiality of data and the security and efficiency of transactions.

The User will enter the credit card data directly on the SSL server, created and guaranteed by the partner (Stripe Inc.) and managed directly by it. In order to be able to access the service, the User must then accept the general terms and conditions prepared by the partner and available at the links https://stripe.com/it-es/ssa. Gonnadu will not be liable for any damages arising to the User from the use of the service proposed by Stripe.

Gonnadu reserves the right to make changes to the amount of the Contribution, even on a case-by-case basis, due to commercial initiatives or pricing policies, even extemporaneous.

Gonnadu is not responsible for billing the amounts paid by the User to the Organizer as a Contribution. The sending of accounting and/or tax documentation, where necessary, will be carried out directly by the entity from time to time obligated to do so under applicable regulations. Gonnadu is in no way obliged to verify the existence of the requirements, conditions and terms within which it is necessary to provide for the issuance of accounting and/or tax documentation, of any kind and type, to Users.

For the purpose of the production and forwarding of tax and accounting documentation (including receipts, receipts, invoices and any other equivalent document, however named) by the party required to do so, only and exclusively the data provided by the Users at the time of registration or otherwise those available in the User’s master data on the Platform will be used. The User undertakes to provide correct, valid and updated information and guarantees that he/she has not provided and will not provide any incorrect or false information. In any case, Gonnadu shall in no case be held responsible for the incorrectness or falsity, whether blameless, culpable or intentional, of the information communicated by Users. The latter agree to indemnify and hold Gonnadu harmless from any damage and/or liability arising, directly or indirectly, from the use of data provided and proven to be incorrect or false.

  1. Fees, Licenses and Certifications.

Gonnadu does not pay taxes on behalf of Users or Organizing Users. Users and Organizers are solely responsible for any Taxes related to them and arising from any Contracts entered into.

Depending on the circumstances, including the number of transactions conducted and the subject matter of the transaction, licenses or certifications may be required by law. 9.2 Limitations of Liability.

Under no circumstances shall Gonnadu be held liable for damages to third parties or contracting parties resulting, directly or indirectly, from the use of the Platform or the Service, or resulting from any contract intervened between the User and third parties. This exclusion of liability shall cover, among others, direct, indirect, incidental, special, exemplary and consequential damages, including: loss of profits, loss of data or loss of goodwill; computer damage; cost of substitute products or services; any damages related to personal or bodily injury.

This limitation of liability shall also be deemed to extend to cases where Gonnadu is advised of the possibility of such damages.

The damages to which the limitation of liability relates may result from: the use or misuse of the Platform or Service; the inability to use the Platform or Service; or the interruption, suspension, modification, alteration, or termination of the Platform or Service.

This limitation also applies with respect to damages incurred from other services or products received through advertising or in connection with the Platform or Service or any link on the Platform, as well as from information or advice received through or advertised in connection with the Platform or Service or any link on the Platform. These limitations apply to the fullest extent permitted by law.

Likewise, Gonnadu is not obliged to verify, either before or afterwards, the comments or feedback (hereinafter, the Feedback) issued by Users regarding a Proposal or an Organizer. If a User or Organizer believes that the Feedback may be offensive to themselves or the community they are requested to immediately notify Gonnadu by writing to support@gonnadu.com.
